The following terms and conditions apply exclusively to online orders via the website. https://www.escuelacoaching.com/  (hereinafter, the "Website"). These conditions of sale are public because they are known to the purchaser. Any order implies acceptance of these conditions by the purchaser. Unless you are contracting for a purpose related to your professional activity, the conditions set out below shall apply in particular in accordance with the contents of the Spanish regulations on consumer and user protection. These conditions shall also fulfil the function of pre-contractual information provided for in said regulations together with the other main characteristics of the products contained in this website, in order to comply with the formal requirements applicable to this type of contract.

If you place an order through https://www.escuelacoaching.com/, you declare that you are over 18 years of age and have the legal capacity to enter into contracts, which are necessary requirements to make a purchase on the aforementioned website. By using this website to place an order, you agree to be bound by these terms and conditions and our privacy policy. Any personal data or information you provide to us will be treated in accordance with the provisions of this privacy policy.

The sales and subsequent invoicing made through this website are made by the owner indicated above.

 

ORDER

To place an order it is necessary to have previously read these general conditions and the privacy policy. The buyer must follow the steps indicated on the website to make the online purchase of the products offered, making the payment of the corresponding price. It is necessary to check your order before processing it, in order to avoid errors. At the end of the order process, the buyer will receive an email as proof of the order.

The sending of the e-mail referred to in the previous paragraph constitutes confirmation of acceptance of the order placed by the purchaser. However, the owner reserves the right to cancel the order, in the particular case that a risk is found to exist.

 

PRICES

All prices are expressed in Euros and are valid for online orders only. Such prices shall specify whether they are tax-free or inclusive of VAT or other taxes (statutory rate in force at the time of invoicing). These prices are not guaranteed. The owner reserves the right to change them at any time, but any changes will not affect orders already confirmed.

 

PAYMENT TERMS AND CONDITIONS

PAYMENT BY BANK CARD

On the website you can make your payments quickly and securely using your debit or credit card (Mastercard and Visa). To do this you will need your card number, expiry date and card verification code or CVV (the last 3 digits on the back of your card).

Orders paid by credit card are automatically validated.

When placing an order on the website, your payment may be subject to an anti-fraud check. Bank cards may be subject to checks and authorisations by the issuing or receiving banks. If the payment is not authorised by the issuing or receiving bank, the cardholder shall not be held liable and the contract shall be deemed not to have been concluded. In this case, an additional 24 hours will be necessary for the processing of your order.

The website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorized access to data. To achieve these purposes, the user/customer agrees that the provider may collect data for the purpose of authentication of access controls. The holder undertakes to follow the security instructions of the payment gateway.

 

RIGHT OF WITHDRAWAL

If you are contracting as a consumer you may desist from the contract for any reason by notifying the holder within 14 calendar days of receipt of the product. You may return the product within this period, at your own expense and accompanied by your invoice and a completed and signed return of goods request. In this case, the amount paid will be refunded.

This right of return only applies to products returned in their original and complete condition (packaging, accessories, user manual, etc.). Any product that has been damaged, is not in its original box or arrives in a broken box beyond the simple opening of the product will not be refunded. The customer will receive the refund once EEC receives the products.

In the event that the products purchased consist of electronic books, taking into account the digital support in which they are supplied and, in accordance with the exception contained in letter m) of article 103 of the General Law for the Defence of Consumers and Users, the right of withdrawal will be lost when the purchaser of a book or form has proceeded to start downloading it.

If the downloading of the product has not started, despite the fact that payment has been made, the purchaser may desist from the contract within 14 calendar days after the contract has been concluded, without giving any reason.

Likewise, in the event that the purchase consists of the provision of a service, the right of withdrawal shall be lost from the moment in which said service has been performed with your consent.

RESPONSIBILITY

EEC shall not be liable for any breach of contract or damage caused by causes beyond its control or not attributable to it. Errors and failures in the information systems required for delivery or any other cause of force majeure shall be considered as non-imputable causes.

INTELLECTUAL PROPERTY

You acknowledge and agree that all copyright, trademark and other intellectual property rights in the products, materials and content sold on this website shall remain at all times vested in EEC or its licensors. You may use such material only as expressly authorized by EEC or any licensor or licensee.

JURISDICTION AND COMPETENCE

These General Conditions shall be governed and interpreted in accordance with common Spanish legislation. Among others, by the Royal Legislative Decree 1/2007 of the General Law for the Defence of Consumers and Users, and Law 34/2002 on information society services and electronic commerce.

Any dispute arising out of or in connection with the conditions of sale shall be subject to the rules of jurisdiction provided for in the Civil Procedure Act.
